Legal Challenge by For-Profit Consortia Seeks Two-Tier Health Care for British Columbians
The Health Sciences Association of B.C., is supporting the BC Health Coalition's intervention in a BC Supreme Court case launched against the BC Medical Services Commission and the BC government by a FOR-PROFIT consortia of private medical clinics.
The consortia is led by British Columbia physician Brian Day, private owner of Cambie Surgery Centre and Specialist Referral Clinic.
The consortia and Day are asking the court to declare unconstitutional, Provincial legislation restricting private medical companies from helping patients "jump queue" for medical services by paying a cash fee.
The Judge in the case, Justice Lynn Smith, granted internenor status in the case to the BC Health Coalition and the organization "Canadian Doctors for Medicare.
In related precedings, Justice Smith ordered an audit of Dr. Brian Day’s , Cambie Surgery Centre.
Day, who admitted to unlawful billing practices was asking the court to block disclosure of the nature and extent of the Centre's illegal billings.
